Terms and Conditions Use of NukeConnect Website This page contains the "Terms and Conditions" under which You or your company may use NukeConnect.com ("NukeConnect.com" or "Website" or “Site”). NukeConnect.com is a professional network that allows users to find and contact other users who have actively listed their profile and/or resume on NukeConnect.com for the purpose of connecting with other users. By using NukeConnect.com, you are agreeing to these Terms and Conditions. If You do not accept the Terms and Conditions stated here, do not use the Web Site or the services provided therein. By using NukeConnect.com, You agree to be bound by the provisions of these Terms and Conditions. NukeConnect.com is a product of NuServ, Inc., a Delaware Corporation ("NukeConnect" or the "Company") may change these Terms and Conditions at any time by updating them on the Website, and may seek remedy for any infringements upon these Terms and Conditions as indicated herein or as allowed by applicable laws. Definitions The terms "You" and "User", as used herein, refer to all individuals and/or entities accessing this Website under any circumstances. The term “Public Users” refers to any user who registers on NukeConnect.com for the purpose of publicly listing (advertising) their resume and/or professional profile on the Site. Use of NukeConnect Content—The trademarks, names, logos and service marks (collectively “trademarks”) displayed on the NukeConnect website are registered and unregistered trademarks of the website owner. The contents of NukeConnect.com, and of all other websites that fall under the Company's control, be it partial or otherwise (NukeConnect.com and other such sites may be as a group referred to as “NukeConnect Sites") including all elements thereof, such as text, graphics, images, logos, button icons, software and other elements (as a group, "NukeConnect Content"), are protected under both United States and foreign copyright, trademark and other laws. All NukeConnect Content is the property of the Company or its partners or clients. NukeConnect is a trademark of NuServ, Inc. "Where the Nuclear Industry Comes Together" is a service mark of NuServ. The compilation (meaning the collection, arrangement and assembly) of all such elements are exclusively the property of the Company and protected under U.S. and international copyright laws. Unauthorized use of the NukeConnect Content may violate copyright, trademark, and other laws. Nothing contained on the NukeConnect website should be construed as granting any license or right to use any Trademark without the prior written permission of the website owner. General Site Restrictions Users are prohibited from using any NukeConnect Site in order to broadcast, dispense, save or demolish material, including NukeConnect Content without limitation, (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or intellectual property rights of others or violate the privacy or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful. Users are also prohibited from trying to violate or violating the security of any NukeConnect Site, including, the following activities without limitation: (a) gaining access to data not intended for said user or logging into a server or account which the user is not authorized to access; (b) attempting to query, scan or investigate the security of a system or network or to compromise security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including, without limitation, by submitting a virus to any NukeConnect Site, overloading, "spamming", "mailbombing" or "crashing"; or (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. The Company will analyze circumstances which may involve such infractions and may engage, and cooperate with, law enforcement authorities in prosecuting users who are engaged in such violations. Specific Site Restrictions NukeConnect.com may only be used for approved and lawful purposes by Users. Approved purposes include: (a) Public Users may create a public profile in order to list and advertise their resumes and their profile to other Users; (b) Users may search and view Public User profiles and communicate with those Public Users. The Company specifically prohibits any other use of the Site, to include: (a) creating fraudulent profiles of any kind (as defined below) (b) posting any content that contains links to any site competitive with NukeConnect; (c) posting content on any NukeConnect Site that contain any hyperlinks, "hidden" keywords or any keywords that are irrelevant to the Public User or User, or otherwise misleading;f (d) publishing to any NukeConnect Site any incomplete, false or inaccurate biographical information or information which is not Your own; (e) deleting or revising any material posted by any other person or entity; (f) initiating any action that incurs an unreasonable or disproportionately large strain on any NukeConnect Site's infrastructure; (g) notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other resource (including without limitation browsers, spiders, robots, avatars or intelligent agents) to view or search any NukeConnect Site other than the search engine and search agents available from the Company on such NukeConnect Site and other than generally available third party web browsers (e.g., Google Chrome, Apple Safari); (h) attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any NukeConnect Site; (i) amassing, copying or duplicating in any fashion any of the NukeConnect Content or information available from any NukeConnect Site; or (j) framing or linking to any of NukeConnect Content or information available from any NukeConnect Site. The following is a partial list of User Content that is prohibited on the NukeConnect Sites: content that is implicitly or explicitly offensive, such as User Content that engages in, endorses or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; harasses, incites harassment or advocates harassment of another any group or individual; promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files; contains restricted or password only access pages, or hidden pages or images; displays or links to pornographic, indecent or sexually explicit material of any kind; provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner, or solicits personal information from anyone under 18; or provides instructional information about illegal activities or other activities prohibited by these Terms, including without limitation, making or buying illegal weapons, violating someone's privacy, or provides or creates computer viruses or pirating any media; solicits passwords or personal identifying information from other Users. External links External links may be provided for your convenience, but they are beyond the control of NukeConnect Inc. and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. Warranties NuServ Inc., through its NukeConnect.com site, makes no warranties, representations, statements or guarantees (whether express or implied in law or in equity) regarding the NukeConnect website or any profiles contained therein.  Furthermore, Users are reminded that personal and professional information is supplied by each User and is not checked or verified by NuServ Inc. or NukeConnect.com.  Other Users should be particularly cautious in relying upon this information without outside corroboration and should also be aware of the potential risks associated with face-to-face meetings with otherwise complete strangers. Public Users who upload a resume and/or create a profile on NukeConnect.com agree to allow NukeConnect to publish their resume and/or profile to the general public, to include their contact information and their name, to all other Users on Site, without exception. Connection Credits You are welcome to connect to other Public Users in order to view their contact information and communicate with them. When connecting to a Public User, your account will be debited Connection Credits, the amount of which shall be indicated at the time that You request a Connection. The number of credits charged for each connection may vary from time to time based on the type of connection or the type of profile. As a new User, you may be issued complementary Connection Credits when you create an account. You may use these credits for Connections or other services on the site that may be available. Connection Credits have no cash value and cannot be redeemed for cash or other forms or monetary reimbursement. You may purchase more Connection Credits at any time through the Website if you wish. Connection Credit purchases are non-transferable and non-refundable. Fraud Protection Users of the NukeConnect.com Website are protected from fraud for thirty (30) days from the date of Connection to a Public User profile on the Site. If You believe that a profile that You have redeemed Connection Credits for is fraudulent, you have (30) days to notify NukeConnect through the NukeConnect.com Site. If you do not notify NukeConnect within thirty (30) days of the Connection Date, your account will not be credited. A Public User profile is considered to be “Fraudulent” ONLY if that profile has NO valid contact information (phone, email, or name). If any of these data fields is accurate, then the Public User profile is NOT considered to be “Fraudulent”. In the event that you report a fraudulent profile, NukeConnect may investigate the profile in question and determine if fraud has occurred. NukeConnect has the sole discretion to determine if fraud has occurred. In the event that fraud has occurred, NukeConnect will provide you with Connection Credits equal to those that were used to make the Connection to the fraudulent profile. NukeConnect will NOT provide cash or credit card refunds under any circumstances. Users who create, aid, coerce, or conspire to create fraudulent profiles with be removed from the NukeConnect Site and have their accounts suspended or terminated. Other Fee Notices Unless otherwise stated, all Connection Credit purchase fees are quoted in U.S. Dollars. If Your payment method fails or Your account is past due, we may collect fees owed using other collection mechanisms (this includes retaining collection agencies and legal counsel). NuServ, Inc. through its NukeConnect.com site, may charge other fees for upgrade services provided to website users. Disclaimer of liability NuServ, Inc and NukeConnect.com shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the NukeConnect website, any information contained on the NukeConnect website, your or your company’s personal information or material and information transmitted over our system. In particular, neither NuServ, Inc. and NukeConnect Inc. nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof. Conflict of terms If there is a conflict or contradiction between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the NukeConnect website shall prevail in respect of your use of the relevant section or module of the NukeConnect website. Severability Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to being void, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be treated as void and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect. Applicable laws (choice of venue and forum)—Use of the NukeConnect website shall in all respects be governed by the laws of the state of Pennsylvania, U.S., regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that the Pennsylvania courts located in Chester County, Pennsylvania, shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts. Term and Termination This agreement shall remain in effect as long as the user maintains an account on the Website. This Agreement shall also remain in effect after account cancellation for as long as necessary to complete all remaining payments and resolve all unresolved disputes and account balances. Once a user has closed their account on the Website, remaining payments have been received and all remaining disputes resolved, this Agreement shall automatically terminate. NukeConnect Privacy Policy NukeConnect takes Your privacy and information security seriously. We continuously strive to ensure the highest level of protection of Your personal data. We do not sell Your data to outside entities. If You choose to provide us with personal information, You consent to the transfer and storage of that information on our servers located in the United States. We may collect and store the following personal information: email address, physical contact information, social security number or tax identification number (for commission payment only), and in some cases financial information, such as credit card or bank account numbers; transactional information based on Your activities on the sites; and billing information. Your interaction with our sites, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information; information from other companies, such as demographic and traffic data; and other supplemental information from third parties. The Company reserves the right to offer third party services and products to You based on the preferences that You identify in Your registration and at any time thereafter; such offers may be made by the Company or by third parties. We may combine Your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. Our primary purpose in collecting personal information is to provide You with a safe, smooth, efficient, and customized experience. You agree that we may use Your personal information to: provide the services and customer support You request; resolve disputes, make payments, collect fees, and troubleshoot problems; prevent potentially prohibited or illegal activities, and enforce our Terms and Conditions; customize, measure and improve our services, content and advertising; tell You about targeted marketing, service updates, and promotional offers based on Your communication preferences; and compare information for accuracy, and verify it with third parties. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a job posting or resume submission or other content violates the rights of others, or protect anyone's rights, property, or safety. We may also share Your personal information with: Members of our corporate family to help detect and prevent potentially illegal acts and provide joint content and services (for example, registration, transactions and customer support). Service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards). Other third parties to whom You explicitly ask us to send Your information (or about whom You are otherwise explicitly notified and consent to when using a specific service). Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, User ID history, IP address, fraud complaints, and bidding and listing history, and in the case of taxation issues, Your Tax Identification Number or Social Security Number. Other business entities, should we plan to merge with or be acquired by that business entity (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to Your personal information. If Your personal information will be used contrary to this policy, You will receive prior notice.). Without limiting the above, in an effort to respect Your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose Your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity. Some of Your user information is displayed throughout NukeConnect and is therefore available to the public. All of Your activity on our sites is traceable to Your user account. Other people can see public profiles, resumes and in some cases Your contact information. We use "cookies" (small files placed on Your hard drive) on certain of our pages to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety. A few important things You should know about cookies are that: We offer certain features that are available only through the use of cookies. We use cookies to help identify You and maintain Your signed-in status. Most cookies are "session cookies," meaning that they are automatically deleted from Your hard drive at the end of a session. You are always free to decline our cookies if Your browser permits, although doing so may interfere with Your use of some of our sites or services. You may encounter cookies from third parties on certain pages of the sites that we do not control (For example, if You view a web page created by another user, there may be a cookie placed by that web page.). We and our users do not tolerate spam. To report NukeConnect-related spam or spoof emails to NukeConnect, please contact NukeConnect customer service. You may not use our communication tools to send spam or otherwise send content that would violate our Terms and Conditions. We automatically scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content, but we do not permanently store messages sent through these tools. Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use tools (encryption, passwords, physical security, etc.) to protect Your personal information against unauthorized access and disclosure. However, as You probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse Your personal information that they collect from the site. Therefore, although we work very hard to protect Your privacy, we do not promise, and You should not expect, that Your personal information or private communications will always remain private. We may amend this Privacy Policy at any time by posting the amended terms on this site. All amended terms automatically take effect 30 days after they are initially posted on the Site.
